Cognitif Group Limited acts as a Data Controller only during each Petalyx™ or HMX session, during which the following items are processed:
Individual choices, audio recordings and response metrics are destroyed on the User's device at the end of the session. Except in cases where data is consensually archived for training purposes, no personal data is retained beyond that session, and the role of Data Controller consequently does not endure.
Because this website does not collect personal data, none is shared with any third party, and none is transferred outside the UK.
For Petalyx™ or HMX sessions, Cognitif Group Limited processes data solely on the basis of its legitimate interest as a market research analytical platform, under UK GDPR Article 6(1)(f). We have assessed that this interest is not overridden by the interests or fundamental rights of the individuals concerned and is in accordance with both GDPR and the EU AI Act.
In exceptional instances where you explicitly consent to the use of input data for internal training purposes, CGL will continue to act as Data Controller until the earlier of (a) the point at which your request for such data to be deleted is actioned or (b) 3 calendar years from the date of capture. No data captured in this way will be shared with 3rd parties except as required by Law.
Our services are built to produce aggregate, population-level measurement, not to identify, profile, or make decisions about specific individuals. Clients and Users may only access our services for lawful, legitimate purposes consistent with this design, and are not authorised to access them, or combine output with other data, to re-identify or single out an individual.
You have the right to object to processing under UK GDPR Article 21. You can exercise this at any time by not starting, or by leaving, a Petalyx™ or HMX session before it concludes, or by contacting the Data Protection Officer.
Except in specific instances where you consent to your input data being used for training purposes, nothing that identifies you is kept after a session ends, and most other implied rights (such as access or erasure) cannot practically apply thereafter, because there is no record of you or of any personal data for us to find.
